1. Agreement to Terms

By accessing or using Shield My Deposit ("Service," "we," "us," or "our") at shieldmydeposit.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Shield My Deposit is operated by Shield My Deposit LLC ("Company"). These Terms constitute a legally binding agreement between you and the Company.

2. Description of Service

Shield My Deposit provides a digital tool that allows users to:

• Upload photos of rental property rooms at the time of move-in or move-out
• Generate timestamped photographic documentation of property condition
• Download a professional PDF report for personal use as documentation

The Service generates documentation intended to assist tenants in disputes regarding security deposits. Shield My Deposit is a documentation tool, not a legal service, and does not provide legal advice.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.

4. User Accounts and Registration

The Service does not currently require account creation for basic use. You may access certain features of the Service without registration. If account features are added in the future, you agree to provide accurate, current, and complete information and to keep that information updated.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service to generate fraudulent, falsified, or misleading documentation
• Upload photos of properties you do not have a legal right to document
• Attempt to manipulate, alter, or falsify timestamps or metadata in any report
• Use the Service to harass, defame, or harm any landlord, property owner, or third party
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use automated scripts, bots, or scrapers to access the Service
• Resell, redistribute, or commercialize the Service or its outputs without written permission

Violation of this Acceptable Use Policy may result in immediate termination of access to the Service and potential legal action.

6. Payment Terms

The Service operates on the following pricing model:

• First Report (Free): Your first complete property report is provided at no charge, with no credit card required.
• Additional Reports: Each subsequent report is available for a one-time payment of $9.99 USD per report.

All payments are processed securely through Paddle, our authorized payment processor and merchant of record. By completing a purchase, you authorize Paddle to charge your payment method. Shield My Deposit does not store your credit card information.

Prices are stated in USD and may be subject to applicable taxes depending on your jurisdiction. Paddle is responsible for collecting and remitting applicable taxes as merchant of record.

7. Intellectual Property Rights

The Service and its entire contents, features, and functionality — including but not limited to all information, software, text, displays, images, graphics, logos, and the design, selection, and arrangement thereof — are owned by Shield My Deposit LLC, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only.

The Shield My Deposit name, logo, brand identity, and all related marks are trademarks of Shield My Deposit LLC. You may not use these marks without prior written consent. This includes any attempt to create derivative products, services, or businesses that replicate or mimic the functionality of the Service.

8. User-Generated Content

You retain full ownership of the photos and content you upload to generate reports. By uploading content, you grant Shield My Deposit a limited license to process your content solely for the purpose of generating your requested PDF report.

You represent and warrant that (a) you own or have the necessary rights to all content you upload, (b) your content does not violate the privacy rights or any other rights of any third party, and (c) your content complies with these Terms and all applicable laws.

Shield My Deposit does not permanently store your uploaded photos on its servers. Photos are processed client-side or temporarily to generate your report and are not retained after report generation.

9. Disclaimer of Legal Advice

Shield My Deposit is a documentation tool. Nothing in the Service, including the generated PDF reports, constitutes legal advice. The reports generated by the Service may be useful as evidence in landlord-tenant disputes, but the Company makes no guarantees regarding their acceptance or weight in any legal proceeding, arbitration, or mediation.

You should consult a licensed attorney in your jurisdiction for legal advice specific to your situation.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SHIELD MY DEPOSIT LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHIELD MY DEPOSIT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Shield My Deposit LLC and its officers, directors, employees, agents, and licensors from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the Service.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in English.
